Subclass 189 Details

This is a permanent visa intended for people that have skills which are in demand within Australia’s labour market. Applicants for this visa do not need a sponsor, but they must pass a points test.

Basic Requirements

In general, this visa allows you to migrate to Australia if you are under 50 years of age, have good English language ability, and skills and qualifications in an occupation required in Australia. 

Points test

This visa is assessed on a points system and 60 points are required to qualify as well as meeting other standard requirements.  Points are awarded in the following categories:

  • Age
  • English Language Ability
  • Australian and Overseas Work Experience
  • Qualifications
  • Australian Study
  • Regional Australian Study
  • Community Language
  • Partner Skills
  • Professional Year

SkillSelect

On 1 July 2012, the skilled migration program switched to a new online system called “SkillSelect” which will require prospective skilled migrants to submit an Expression of Interest (EOI). Once an EOI is submitted, these details can be viewed by Australian employers, state and territory governments and by the Australian Government who have the ability to extend an invitation to lodge a visa application.

Invitations under this subclass will be issued based on each occupation category. Applicants with the highest points within each category will be offered the first invitations. Therefore the aim is to score as many points as possible.

Benefits of Skilled Independent Permanent Residency Visa

Successful applicants and holders of a 189 Skilled Independent visa become permanent residents of Australia. Australian permanent residents are entitled to live, work and study in Australia on a permanent basis. Additional benefits of Australian permanent residence include access to government-subsidised healthcare (Medicare), certain social security benefits and the ability to apply for Australian citizenship.

Subclass 190 Details

This is a permanent visa for skilled workers who are sponsored by an appropriate State or Territory government body.  Applicants for this visa still need to pass a points test but obtain 5 bonus points for having a State or Territory sponsor.

Applicant for this visa requires sponsorship from a State Government in order to apply.

Successful applicants and holders of a 190 Skilled Sponsored visa become permanent residents of Australia. Australian permanent residents are entitled to live, work and study in Australia on a permanent basis. Additional benefits of Australian permanent residence include access to government-subsidised healthcare (Medicare), certain social security benefits and the ability to apply for Australian citizenship.

Subclass 489

This is a 4 year temporary visa in Australia for skilled workers who are nominated by a State or Territory or sponsored by an eligible relative living in a designated area in Australia.

Applicants need to pass the points test and receive 10 bonus points for having a sponsor.  Holders of this visa are permitted to apply for a permanent visa after they have lived for 2 years and worked for at least 1 year in a Specified Regional Area.

Requirements

489 Skilled Regional Sponsored Temporary Visa is a temporary work visa for individuals who have the qualifications and skills required to address Australia’s skill shortage, but cannot meet the pass mark required to obtain a Skilled Independent or Skilled Sponsored visas. 

Sponsorship

Applicants are required to obtain a minimum of 60 points on a point assessment and must either obtain sponsorship from an eligible relative living in a Specified Regional Area of Australia or nomination from a participating State or Territory government.

To be sponsored by a relative, an applicant’s Australian relative must live in a Specified Regional Area of Australia* and the applicant (or their spouse) must be related to their sponsor as either:

  • a child – including a stepchild, or
  • a parent – including a step-parent, or
  • a brother or sister – including adoptive or step-sibling, or
  • a niece or nephew – including adoptive or step-niece or nephew, or
  • an aunt or uncle – including adoptive or step-aunt or uncle, or
  • a grandparent or first cousin.

*The definition of Specified Regional Area of Australia depends on whether the applicant is sponsored by a relative or nominated by a State or Territory government. As a general indication, the following areas are considered regional:

  • New South Wales – everywhere except Sydney, Newcastle, the Central Coast and Wollongong;
  • Northern Territory – everywhere;
  • Queensland – everywhere except the greater Brisbane area and the Gold Coast;
  • South Australia – everywhere;
  • Tasmania – everywhere;
  • Victoria – everywhere except the Melbourne metropolitan area; and
  • Western Australia – everywhere.

To be nominated by a State or Territory government, applicants must satisfy specific criteria, as set by the particular State or Territory. These may include:

  • having an occupation on the skills shortage list in that State or Territory; or
  • demonstrating specialised skills in an area of need. 

Pathway to Permanent Residency

Holders of this visa are permitted to apply for a permanent visa after they have lived for 2 years and worked for at least 1 year in a Specified Regional Area. 

Subclass 485

This visa allows international students to live and work in Australia temporarily after they have finished their studies in Australia, this visa can be granted for up to 4 years, depending on their qualification.

Graduate Work stream 

This stream is for international students who graduates with skills and qualifications that closely relates to an occupation on the Skilled Occupation List (SOL). A visa in this stream is granted for 18 months.

To apply, applicant must have:

  • An Occupation on Schedule 1 of the SOL
  • IELTS 6.0 (Competent English)
  • Apply within 6 months of meeting the Australian Study Requirement (2 years study within Australia).

Post-Study Work stream 

This stream is for international students who graduate with eligible qualification. 

This stream is only available to students who applied for and were granted their first Student visa to Australia on or after 5 November 2011. A visa in this stream can be granted for up to 4 years, depending on the qualification.

There is no list of occupations for this visa stream and there is no requirement to apply for a Skills Assessment for this visa stream. Applicant must have IELTS 6.0 (Competent English).

Applicant will also need to apply within 6 months of meeting the Australian Study Requirement and have completed a Degree, Masters or Doctorate at an Australian University or College that has a registered degree or higher CRICOS course.

The length of the visa granted will be:

  • Bachelor Degree – 2 Years
  • Master Degree – 3 Years
  • PhD – Doctorate Degree – 4 Years.
